CDT Licensing Programs for Commercial Users

The ADA strives to make the CDT widely available, at a reasonable cost, to the entire dental community, including commercial users. For commercial users of the CDT, ADA offers a variety of licensing programs to meet your business needs.

Commercial users include software vendors, print and/or electronic publishers, academic institutions and educators, government agencies, consultants, actuaries and other professionals, dental insurers, third party claims processors, and anyone providing or administering dental benefits. The ADA has seven licensing categories to meet your needs, listed below.

Except as permitted by law, all use, copying or distribution of the CDT, or any portion thereof (including the Code on Dental Procedures and Nomenclature) in any product, publication report, document, presentation, fee schedule, user manual, advertising, marketing or promotional materials or derivative work relating to your products or services (including works prepared for clients by consultants and other professionals), whether in printed, electronic or other format, requires a valid commercial user license from the ADA.

CDT Licensing Agreements

Commercial users in categories 1-6 below must complete and return a CDT License Application & Questionnaire to ADA prior to being granted a CDT License. Incomplete Applications will be returned by ADA to the applicant for completion. Please contact Tamra Kempf, Esq., via e-mail at kempft@ada.org if you have any further questions about CDT Licensing.

The following types of CDT Licenses are available to commercial users.

1. Software License—Grants a license to software developers to incorporate and distribute the CDT content solely as part of Licensee's application software product (the bundled product). Licensee is permitted to incorporate the CDT content into the bundled product in a non-static text format. “Non-static” text means that the CDT data can be removed and used separately from the other non-CDT content contained in Licensee’s bundled product. Thus, bundled product has functionality that enables end user to: sort, filter, rearrange, copy, print and/or electronically transmit the CDT data (or portions thereof); copy CDT data into new documents; and combine CDT data with non-CDT data, such as reports and patient billing statements.

CDT License for Practice Management Software Vendors: License is granted solely to vendors who develop/distribute practice management software designed for use in a private dental office or other care facility where patients are receiving direct treatment. This CDT License grants licensee a right to sublicense use of CDT to ultimate end user.

CDT License for Software Developers: License to vendors who develop/distribute application software for other uses in the dental industry (other than dental office management and direct patient treatment), such as for claims processing. THIS CDT LICENSE GRANTS NO RIGHT TO SUBLICENSE USE OF CDT TO ULTIMATE END USER.

2. Publisher License—Grants a license to republish the CDT content in print and/or electronic books, such as textbooks, reference manuals and practice management guides. For electronic books, license allows use of the CDT content in only in static text format. "Static" text means that CDT data cannot be removed or used separately from its non-CDT editorial content. Thus, ultimate end user is not permitted to: sort, filter, rearrange, copy, print and/or electronically transmit the CDT data (or portions thereof); copy CDT data into new documents; or combine CDT data with non-CDT data, such as reports or patient billing statements. 3. Associations and Educational Organizations—Grants a license to educators to use the CDT content in course presentations and student handout materials for dental coding educational seminars and workshops.

4. Government User License—Grants a license to departments and agencies of a federal, state or local government.

5. Dental Benefit Plans License—Grants a license to dental benefits companies and third party administrators of dental benefits programs.

6. Consultant/Professional License—Grants a license to consultants and other professionals who distribute copies of the CDT to third parties in the course of providing consulting or other professional services, such as fee schedule reviews or actuarial services.

Commercial users in categories 1-6 above must complete and return a CDT License Application & Questionnaire to ADA prior to being granted a CDT License. 7. NADP (National Association of Dental Plans) Member License—Available only to members of the National Association of Dental Plans. This License Agreement is the result of the NADP Member Program jointly designed by ADA and NADP. The CDT Content License for NADP Members includes discounted pricing, along with expedited contract administration process and special payment procedures.

8. AHIP ( America’s Health Insurance Plans)—Available only to members of the America’s Health Insurance Plans. This License Agreement is the result of the AHIP Member Program jointly designed by ADA and AHIP. The CDT Content License for AHIP Members includes discounted pricing, along with expedited contract administration process and special payment procedures.

1. Software License

  • Non-exclusive license to incorporate and distribute CDT solely as part of Licensee's application software product.
  • No right to distribute the CDT, except as bundled with Licensee's application software product.
  • Licensee may NOT use bundled product to create and distribute reports or other derivative works containing CDT to third parties.
  • Licensee's bundled product may contain functionality that enables ultimate end user permitted to manipulate the CDT content and separate it out from non-CDT content contained in Licensee’s software.
  • Licensee's bundled product may contain functionality that enables ultimate end user to: sort, filter, rearrange, copy, print and/or electronically transmit the CDT data (or portions thereof); copy CDT content into new documents; and combine CDT content with non-CDT data, such as reports and patient billing statements.
  • License fee varies, based on type of software application and identity of end user.
  • Royalty reports and payments are due annually.
  • Practice Management Software Vendors: CDT License grants licensee a right to sublicense use of CDT to ultimate end user.
  • Software Developers: CDT LICENSE GRANTS NO RIGHT TO SUBLICENSE USE OF CDT TO ULTIMATE END USER.

2. Publishers License

  • Non-exclusive license to republish the CDT in print and electronic books. All use of the CDT content must be as static text.
  • No right to distribute the CDT, except as part of the publication.
  • Neither Licensee nor User may use publication to create and distribute reports or other derivative works containing CDT to third parties.
  • User may NOT manipulate the electronic book’s CDT content and separate it out from non-CDT content.
  • Electronic book may NOT contain functionality to sort, filter, rearrange, copy, print and/or electronically transmit the CDT data (or portions thereof); copy CDT data into new documents; and combine CDT data with non-CDT data, such as reports and patient billing statements.
  • License term runs from date of execution to December 31, 2006.
  • Royalty is 7.5% of net sales revenue.
  • Royalty reports and payments are made annually.

3. Associations and Educational Organizations

  • Non-exclusive license to use the CDT in instructor's presentations and student educational materials used in connection with a dental coding educational class, workshop or seminar hosted by Licensee.
  • Licensee may NOT distribute course materials, except to attendees of Licensee's course and as part of the course materials.
  • License term runs from date of execution to December 31, 2006.
  • Annual license fee is $1000.

4. Government User License

  • Non-exclusive license to use the CDT for licensee's internal business purposes, including processing claims, designing benefit plans and developing utilization data.

5. Dental Benefit Plans License

  • Non-exclusive license to use the CDT for licensee's internal business purposes, including processing claims, designing benefit plans and developing utilization data.
  • Annual license fees based on Licensee's total number of Enrollees.

6. Consultant/Professional License

  • Non-exclusive license to create and distribute reports or other derivative works containing CDT to third parties.
  • Annual license fee TBD.
