McCarran-Ferguson
At Issue
In 1945, Congress passed the McCarran-Ferguson Act to clarify that states could continue to regulate and tax insurers—giving the insurance industry a limited exemption from federal antitrust laws. The ADA is working to overturn parts of the McCarran-Ferguson Act and reverse insurance industry’s exemption from anti-trust regulations. This is an uphill battle, and while we have found champions on both sides of the aisle—and narrowly missed seeing an amendment voted into a key bill—the insurance industry is not without friends. We intend to persevere in our efforts to level the playing field and force insurance companies to comply by the same rules that govern the rest of us.
Some members of Congress are interested in introducing bills that would remove the insurance industry’s exemption. We are in contact with these members, informing them of our support for such legislation.
